Changing the Numbers, Not the Zoning

Alongside the uses it permits, every zoning carries a set of development parameters: how much of the erf you may cover, how high you may build, how much floor area you may put on the site, and how many parking bays you must provide. A departure asks the municipality to relax one of them for your property. The zoning is untouched and the permitted uses are unchanged. What moves is a single number — and that is often the difference between a scheme that works and one that does not.

What a Departure is not

Not a rezoning, which changes the category. Not a consent use, which permits an additional use. Building line relaxations are departures too — that one has its own page.

When a Departure is the Route

When You Need a Departure

A departure is the right application when the use is permitted but the numbers do not work. In our experience, these are the four situations that call for it.

The scheme is close but not close enough

Your design exceeds coverage, height or floor area by a margin the scheme does not allow, but the use itself is permitted as of right.

Parking cannot be provided on site

The bays the scheme requires will not fit, or fitting them would cost the site more than the development is worth.

The use is temporary

A show house, site office or seasonal operation needed for a defined period. A temporary departure suits it better than a permanent change.

Building control has rejected plans

Plans have come back because they exceed a scheme parameter. The departure is what makes the same plans approvable.

Where the departure sought is large, a rezoning to a category that carries the parameters you need may be the sounder route. Which applies depends on how far the numbers are from the scheme, and we establish that before advising.

Coverage

Building on more of the erf

The footprint exceeds the percentage of the site the scheme permits. Common on smaller erven and on additions to existing houses.

Height

An additional storey

The building exceeds the permitted height or storey count. Overlooking and shadow on neighbouring erven are the usual objections.

Floor Area

More bulk than the ratio allows

The scheme sets a floor area ratio against the erf size. Where the scheme needs more bulk to be viable, the departure is the route.

Parking

Fewer bays than required

The required bays will not fit, or the site is well served by transport. A traffic assessment usually carries the argument.

Temporary

A use for a fixed period

A show house, site office or seasonal operation, permitted for a stated term and reverting when it expires.

Departures are assessed together, not one at a time. A scheme seeking a small relaxation on coverage is one thing; a scheme seeking coverage, height and parking at once is read as a proposal the zoning does not support — and at that point a rezoning is usually the stronger application.

The shortest of the land use applications, and the only one whose purpose is to unlock a building plan. It ends where building control begins.

The schedule of deviations is drawn up, the motivation written, and any specialist input commissioned.

Advertising

Notice is given as the by-law requires. Adjoining owners are the ones affected by coverage, height and overlooking.

Decision

Granted, granted in part, or refused. A partial grant is common — the height may go and the coverage may not.

Conditions

Plans are lodged with building control against the relaxed parameters. The departure only has value once they are approved.

What a Departure Costs

Usually the smallest planning fee on a project, and frequently the one that makes the rest of it possible. Four things move the figure.

How many parameters

One relaxation is a short submission. Three have to be argued separately and defended together, and each adds to the schedule of deviations.

Specialist input

A traffic impact assessment on a parking departure or a shadow study on a height departure is commissioned separately and often exceeds the planning fee.

Likelihood of objection

Height and coverage departures affect the neighbours directly. An opposed matter goes to the Tribunal, with a hearing and expert evidence.

Drawings and revisions

This application is argued on drawings. Where the design changes during the process, the schedule and the submission change with it.

Weigh it against the cost of designing around the constraint. A departure that unlocks an extra storey or twenty square metres of floor area is frequently cheaper than the redesign, the lost yield or the smaller building that avoiding it would produce. That comparison is the first thing we run.

How much of a departure will the municipality grant?

There is no fixed allowance. A departure is assessed on the impact of the relaxation, not on a percentage — a modest coverage increase on an internal erf may be granted where the same increase on a corner site is refused. What we can tell you at assessment is which of the parameters you need are realistically winnable, and which are likely to attract a refusal or a partial grant.

What is the difference between a permanent and a temporary departure?

A permanent departure relaxes a parameter indefinitely; the relaxed figure applies to the property from then on. A temporary departure permits something for a stated period, after which the position reverts. Show houses, site offices and seasonal operations are the usual candidates for the temporary version — it suits a use that genuinely ends, and it is easier to motivate than a permanent change for the same thing.

My building plans were rejected. Is a departure the answer?

Often, yes. Where building control has returned plans because they exceed a scheme parameter — coverage, height, floor area or parking — a departure is what makes the same drawings approvable, without redesigning. Where the rejection is for a use the zoning does not permit, or for non-compliance with the National Building Regulations, a departure will not help. The first thing to establish is which of the two you have, and that is answered from the rejection letter.

Can I apply for several departures at once?

Yes, and they are lodged as one application with a schedule setting out each. But they are assessed together, and a scheme seeking several substantial relaxations reads to a municipality as a proposal the zoning does not support. Where two or three parameters have to move materially, a rezoning to a category that already carries them is usually both stronger and more durable.

Can my neighbours block a height departure?

Not by themselves. An objection refers the matter to the Municipal Planning Tribunal, which weighs it on statutory validity rather than volume. On a height departure the objections that carry weight are the substantiated ones — overlooking into a private space, loss of light, an effect on the streetscape. A general objection to a taller building next door carries very little. In our experience the effective response is a shadow study and a sensitively resolved elevation, prepared before the objection rather than after.

Does a departure run with the property when I sell?

Yes, materially. The by-law requires an unopposed consent use to be decided within 60 days of the administrative phase closing, against 90 days for other land development applications. Allowing for compilation, advertising and the municipality's actual turnaround, an unopposed consent use in Johannesburg typically runs four to six months against six to nine for a rezoning. Objections change that on either.

Do I need an architect as well as a planner?

Usually. A departure is argued on drawings — footprint, elevations, sections showing the relaxation in context — and the quality of those drawings does more for the application than the prose does. Our architects and planners work in the same practice, so the schedule of deviations and the drawings it refers to are prepared together rather than passed between firms.
